Welcome to Giromio! These Terms of Service ("Terms") constitute an agreement between you and Giromio regarding the use of our cross-border remittance services. Please read and fully understand all the contents of these Terms, particularly the clauses relating to disclaimers, limitation of liability, and dispute resolution.
By using Giromio's services, you acknowledge that you have read, understood, and agreed to be bound by these Terms.
1. Service Overview
Giromio is a cross-border remittance service platform that provides users with fund transfer services from Chile to China and other countries and regions. Our services include but are not limited to:
- Cross-border remittance transfers
- Real-time exchange rate inquiries
- Beneficiary management
- Transaction record inquiries
2. Account Registration and Management
1. Registration Requirements
To use Giromio services, you must:
- Be at least 18 years of age with full civil capacity
- Provide true, accurate, and complete registration information
- Complete the identity verification (KYC) process
2. Account Security
- You are responsible for safeguarding your account information and login password
- You must not transfer, lend, or provide your account to others for use in any manner
- If you discover any abnormal or unauthorized use of your account, you must notify us immediately
- Losses resulting from your failure to properly safeguard your account information shall be borne by you
3. Identity Verification
In accordance with Anti-Money Laundering (AML) and Know Your Customer (KYC) regulations, you are required to provide valid identity documents and complete verification. We reserve the right to request additional identification or proof of source of funds when necessary. If you fail to pass identity verification, we reserve the right to restrict or terminate your account.
3. Remittance Services
1. Remittance Process
- You submit a remittance instruction on the platform, confirming the remittance amount, beneficiary information, and applicable exchange rate
- After submitting the remittance instruction, you must complete payment as directed by the platform
- Upon receiving and confirming your payment, we will transfer funds to the beneficiary as agreed
- Actual arrival time depends on the processing speed of the receiving bank and relevant intermediary institutions
2. Exchange Rates and Fees
- The exchange rate is based on the real-time rate displayed on the platform at the time you submit your remittance instruction
- Remittance fees and other related charges will be clearly displayed before you submit the remittance
- Exchange rates may fluctuate due to market conditions; the exchange rate after transaction confirmation will not be adjusted
3. Transaction Limits
- Single and cumulative remittance amounts are subject to legal and regulatory requirements as well as platform rules
- Specific limit standards are as published on the platform; we reserve the right to adjust limits based on regulatory requirements or risk control needs
4. Remittance Cancellation and Refunds
- Once a remittance instruction has been confirmed and payment completed, it cannot be cancelled in principle
- If cancellation is needed for special reasons, please contact customer service as soon as possible, but we do not guarantee successful cancellation
- Refunds will be subject to deduction of incurred fees and exchange rate differences
4. User Obligations
When using Giromio services, you agree to:
- Comply with the laws and regulations of Chile, China, and other relevant countries and regions
- Not use the platform for money laundering, terrorist financing, tax evasion, or any other illegal activities
- Only use funds under your own name for remittances
- Ensure the legality of the source of funds for remittances
- Ensure the beneficiary information provided is true and accurate
- Not use the platform for any fraudulent or improper conduct
- Cooperate with our legally required identity verification and transaction investigations
5. Prohibited Activities
The following activities are strictly prohibited:
- Providing false identity information or forging documents
- Using the platform for money laundering, terrorist financing, or other illegal activities
- Structuring transactions to circumvent transaction limits or regulatory requirements
- Using another person's account or allowing others to use your account
- Employing technical means to interfere with or disrupt the normal operation of the platform
- Any conduct that violates applicable laws and regulations
If we discover or have reasonable grounds to suspect that you are engaged in any of the above activities, we reserve the right to immediately suspend or terminate your account, freeze related funds, and report to the relevant authorities.
6. Risk Disclosure
1. Exchange Rate Risk
Foreign exchange rates are affected by various factors and may fluctuate at any time. We are not responsible for any losses caused by exchange rate fluctuations.
2. Transfer Delays
Due to receiving banks, intermediary banks, holidays, system maintenance, or other uncontrollable factors, arrival times may be delayed.
3. Compliance Reviews
Due to anti-money laundering compliance review requirements, certain transactions may require additional review time. We reserve the right to withhold funds from suspicious transactions.
7. Disclaimers
To the maximum extent permitted by law:
- Giromio shall not be liable for service interruptions or losses caused by force majeure (including but not limited to natural disasters, war, government actions, cyber attacks)
- Giromio shall not be liable for fund losses resulting from incorrect beneficiary information provided by you
- Giromio shall not be liable for acts or omissions of third-party banks or financial institutions
- Platform services are provided on an "as is" basis without any express or implied warranties
8. Intellectual Property
All content on the Giromio platform, including but not limited to text, images, logos, software, and their design, are the intellectual property of Giromio or its licensors and are protected by law. Unauthorized reproduction, modification, distribution, or other use is prohibited.
9. Service Changes and Termination
1. Service Changes
We reserve the right to modify, suspend, or terminate part or all of our services at any time, and will notify you in advance through platform announcements or other means.
2. Account Termination
We reserve the right to suspend or terminate your account under the following circumstances:
- Violation of these Terms or applicable laws and regulations
- Failure to pass or refusal to cooperate with identity verification
- Account suspected of fraud or other illegal activities
- Dormant accounts that have been inactive for an extended period
- As required by regulatory authorities
3. Consequences of Termination
After account termination, we will handle the remaining funds in your account in accordance with laws and regulations. Due to compliance requirements, certain information may continue to be retained for the statutory period after account termination.
10. Changes to These Terms
We may revise these Terms from time to time, and the revised content will be notified to you through platform announcements, email, or push notifications. The revised Terms take effect from the date of publication. Your continued use of Giromio services after the Terms update indicates your acceptance of the updated Terms.
If you do not agree with the revised Terms, you have the right to stop using our services and cancel your account.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of Chile. Any disputes arising from or related to these Terms shall first be resolved through amicable negotiation between the parties; if negotiation fails, either party may file a lawsuit with a court of competent jurisdiction in the Republic of Chile.
